Acceptance of Terms

By accessing or using the Testfly platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

Description of Service

Testfly is an AI-powered behavioral QA platform that enables users to record user flows, generate living specifications, and run automated behavioral comparisons to detect regressions. The Service includes the web application, browser extension, API, and any related tools or documentation.

User Accounts

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete registration information.
  • Keep your login credentials secure and confidential.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity on your account.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Record, test, or interact with websites or applications without proper authorization.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Transmit malicious code, viruses, or any other harmful technology.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to build a competing product or service.

Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by Testfly and protected by intellectual property laws. You retain ownership of all data, recordings, and specifications that you create using the Service. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.

We do not claim ownership over your recordings, living specs, or any other content you create through the platform.

Limitation of Liability

To the maximum extent permitted by law, Testfly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use of or inability to use the Service.
  • Any unauthorized access to or use of our servers or your data.
  • Any interruption or cessation of the Service.
  • Any errors, inaccuracies, or omissions in comparison results or generated specifications.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

Termination

You may terminate your account at any time by contacting us or using the account settings in the portal. We may suspend or terminate your access to the Service if you violate these Terms or if required by law. Upon termination:

  • Your right to use the Service will immediately cease.
  • You may request export of your data within 30 days of termination.
  • We may delete your data after a reasonable retention period following termination.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
